PRODUCTIVITY: THE GOOD, THE BAD AND THE UGLY
This session will be held in two parts. First, Dr. J. Ruwanpura will discuss the Construction Productivity Improvement research project at the University of Calgary under the theme of Top Ten Targets of Improving Construction Productivity. His presentation will cover areas such as: survey results, a Tool time analysis from actual construction projects, a simulation model to predict the construction productivity, a human expectancy motivation model, recommendations, and Top Ten Target research areas of present and future research.

Mr. Stephen Revay will then discuss productivity as it pertains to construction claims. The presentation will include the following: factors which give rise to adverse productivity, time on the tools vs. productivity, the abuses in quantifying productivity loss, and alternative quantification methods and when they should be used.

MOST CURRENT LEGAL ISSUES
At the 2006 CCA Conference in Hawaii, we explored the hottest legal issues of 2006 confronting the construction industry. This session will pick up where we left off by considering the hottest legal issues existing or anticipated for 2007. A team of legal experts from the Toronto, Vancouver, Calgary, Ottawa and Montréal offices of Borden Ladner Gervais LLP will explore some of the more critical legal principles affecting the business of construction from procurement (such as bidding and contract matters) to project delivery (such as delay or impact claims, claims for extras, the importance of notice provisions, limitation periods, Occupational Health and Safety, insurance, bonding and others) to public private partnerships to practical dispute resolution for contractors and subtrades to construction fraud. Owners must ensure they have a systematic method whereby the entire team is managed effectively on a construction project. Far too often, the owner's project management fails to integrate smoothly with that of the contractor, leading to issues which impact all parties and possibly even active disputes. Both the owner's staff and the contractor's staff need to be clear about the differences in contract type to avoid confusing roles.

This session will provide an overview of the differing roles each party must play, depending on the contractual arrangements among them, and how to avoid problems.
